1. Order Acceptance & Pricing

Order Confirmation: Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order for any reason, including product availability or errors in pricing or descriptions.

Pricing Errors: In the event of a pricing error, we reserve the right to cancel any orders placed for that item, even if the order has been confirmed and your payment method charged. If your payment has been processed, we will issue a full refund.

Sales Tax: Sales tax is calculated based on the shipping destination. A+D Trade clients must provide a valid tax exemption certificate prior to purchase and are subject to the terms outlined in our A+D Terms & Conditions.

2. Custom & Made to Order Items

Definition: Custom or Made to Order items include any product where you select a specific finish, upholstery, or configuration.

Final Sale: These items are manufactured specifically for you and are Final Sale. They cannot be returned, exchanged, or canceled once production has begun.

Grace Period: You have a 48 hour window from the time of payment to request changes or cancellations on custom orders. After 48 hours, orders are sent to the manufacturer and are non-alterable.

Lead Times: Lead times are good faith estimates provided by our manufacturers. Lekker Home is not liable for delays caused by production, global logistics, or raw material shortages.

3. Shipping & Delivery

Risk of Loss: All items are purchased pursuant to a shipment contract. This means the risk of loss and title for such items pass to you upon our delivery to the carrier.

Delivery Inspection (The “48 Hour Rule”): You must inspect all items immediately upon delivery. Any damage, shortages, or discrepancies must be reported to [email protected] within 48 hours of receipt. Failure to report within this window constitutes full acceptance of the goods.

Fit & Access: It is the customer’s responsibility to ensure that items will fit through doorways, elevators, and hallways. If an item is refused because it does not fit, it will be treated as a return and subject to a 20% restocking fee and non-refundable shipping charges.

5. Product Variations

Natural Materials: Many of our products utilize natural wood, leather, or stone. You acknowledge that variations in grain, texture, and color are inherent to these materials and are not considered defects.

Digital Accuracy: We strive for color accuracy, but we cannot guarantee that your monitor’s display of any color will be 100% accurate to the physical product.

6. Limitation of Liability

Disclaimer: Lekker Home provides its website and services on an “as is” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

Liability Cap: In no event shall Lekker Home, its directors, or employees be liable for any indirect, incidental, or consequential damages (including loss of profits) arising from the use of our products or website. Our total liability shall not exceed the purchase price of the specific product in dispute.

7. Force Majeure

Lekker Home shall not be held responsible for any delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, pandemics, or carrier delays.

8. Dispute Resolution & Arbitration

Governing Law: These terms are governed by the laws of the Commonwealth of Massachusetts.

Mandatory Arbitration: You agree that any dispute or claim arising out of these Terms or your purchase will be settled by binding arbitration in Boston, MA, rather than in court.

Class Action Waiver: You agree to bring any claims against Lekker Home only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

All content on this site, including photography, logos, and text, is the property of Lekker Home or its brand partners. Any unauthorized use, reproduction, or scraping of this content for commercial purposes is strictly prohibited.
